this is the end-user license agreement (eula) for the ghost ios application ("ghost", "the app"). by installing or using ghost you accept this agreement. if you do not accept it, do not install or use the app.

[before publishing: replace "the developer" throughout this document with your registered legal entity name (or sole-proprietor name) so the agreement is enforceable.]

note: apple's standard end user license agreement (the "Standard EULA" referenced at apple.com/legal/internet-services/itunes/dev/stdeula) governs the relationship between you and apple. the eula below is a supplementary agreement between you and the developer, the developer of ghost.

01license grant

the developer grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use ghost on apple devices that you own or control, in accordance with the apple media services terms and the app store usage rules. this license is for your personal, non-commercial use.

02scope of license

you may not, and you may not permit anyone else to, except as expressly authorized by applicable law:

03ownership

ghost is licensed to you, not sold. the developer retains all right, title, and interest in and to the app, including all intellectual property rights. you retain all rights to the content you write inside the app — your words remain yours.

04third-party services

ghost does not integrate any third-party services, sdks, or apis. it makes no network requests of its own. apple's storekit framework is used solely to verify the in-app purchase and is governed by apple's terms.

05data and privacy

see the privacy policy. in summary: nothing leaves your device.

06updates

the developer may, but is not obligated to, provide updates to the app. updates may add, change, or remove features. they may also change the price for new purchases (existing one-time unlocks are not affected).

07termination

this license is effective until terminated. it terminates automatically if you fail to comply with any term. on termination, you must stop using and delete all copies of the app. sections of this eula that by their nature should survive termination (ownership, liability, governing law) will survive.

08warranty disclaimer

the app is provided "as is" and "as available", with all faults and without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. the developer does not warrant that the app will meet your requirements or operate uninterrupted or error-free.

09limitation of liability

to the maximum extent permitted by law, in no event will the developer be liable for personal injury or any incidental, special, indirect, or consequential damages whatsoever, including without limitation damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use of the app, however caused, regardless of the theory of liability (contract, tort, or otherwise).

10third-party beneficiary

you acknowledge and agree that apple, and apple's subsidiaries, are third-party beneficiaries of this eula and that, on your acceptance of the terms and conditions of this eula, apple will have the right (and will be deemed to have accepted the right) to enforce this eula against you as a third-party beneficiary.
