Terms of Use

These Terms of Use (the "Terms") govern your use of the "Pool" iOS, iPadOS, watchOS and macOS application (collectively, the "App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
These Terms incorporate Apple's standard End-User License Agreement (EULA), which Apple requires us to apply to App Store distribution. If anything in these Terms conflicts with that EULA, Apple's EULA controls for the App's licensing terms.
1. License
We grant you a limited, non-transferable, non-exclusive license to install and use the App on devices that you own or control, as permitted by Apple's Usage Rules in the App Store Terms of Service.
2. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law.
- Use the App to harass, abuse, or harm another person.
- Distribute, resell, or sublicense the App.
3. Subscriptions and one-time purchases
3.1 Pool Pro tiers
- Pool Pro · Monthly — auto-renewing subscription at the price displayed in the App at the time of purchase (USD $4.99 in the U.S. App Store; pricing may differ by region).
- Pool Pro · Yearly — auto-renewing subscription at the price displayed in the App at the time of purchase (USD $24.99 in the U.S. App Store; pricing may differ by region).
- Pool Pro · Lifetime — one-time, non-consumable purchase that grants Pool Pro access for the lifetime of the App (USD $49.99 in the U.S. App Store).
- Pool Kids · Lifetime — one-time, non-consumable purchase intended for kids and classrooms; suppresses upgrade prompts (USD $19.99 in the U.S. App Store).
3.2 Auto-renewal (subscriptions only)
Subscriptions automatically renew at the end of each billing period (one month for Monthly; one year for Yearly) unless canceled at least 24 hours before the end of the current period. Your iTunes/Apple Account is charged at confirmation of purchase and at each renewal.
3.3 Managing or canceling
You can manage subscriptions or turn off auto-renewal at any time from your device: Settings > [your name] > Subscriptions on iOS, or App Store > account > Subscriptions on macOS. Cancellation takes effect at the end of the current billing period; you keep Pool Pro access until then.
3.4 Refunds
All purchases are processed by Apple. Refund requests are handled by Apple in accordance with their policies; we do not have the ability to issue refunds directly. To request a refund, visit reportaproblem.apple.com.
3.5 Free tier
Pool's free tier is provided at no charge and includes the Pool shape, sessions up to 60 minutes, and a daily message limit on Companion. The free tier may change in future updates; existing one-time-purchase customers (e.g. Lifetime) keep what they paid for.
4. In-app content (Companion)
The Companion feature inside Pool generates messages locally on your device using a deterministic-style template algorithm. Replies are procedurally assembled from a fixed pool of phrases; they are not professional advice (medical, psychological, legal, financial, or otherwise) and should not be relied on as such. If you are in distress, please contact a qualified professional or emergency services in your area.
5. No warranty
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted or error-free.
6. Limitation of liability
To the maximum extent permitted by law, in no event shall the developer of Pool be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the App. Our total liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid (if any) for the App in the 12 months preceding the claim.
7. Apple as third-party beneficiary
You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
8. Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by deleting it from your device. Sections that by their nature should survive termination (warranty disclaimers, limitations of liability, indemnification, and these miscellaneous provisions) will survive.
9. Changes to these Terms
We may revise these Terms from time to time. The most current version will always be posted at this URL. Material changes will be summarized in App release notes when relevant. Your continued use of the App after changes are posted constitutes your acceptance.
10. Governing law
These Terms are governed by the laws of the jurisdiction in which the developer is based, without regard to conflict of laws principles, and by Apple's standard EULA for the licensing portion. Nothing in these Terms limits any non-waivable consumer rights you may have under the law of your country of residence.
