End User License Agreement

This End User License Agreement (“Agreement”) is a legal agreement between you and Zhang Jiahao (“we,” “us,” or the “Developer”) for the use of the Booth iOS application and its updates (the “App”). By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.

Booth is licensed for use through the Apple App Store and is also subject to Apple's standard Licensed Application End User License Agreement (the “Apple Standard EULA”), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where this Agreement and the Apple Standard EULA address the same subject, the more protective terms for you as the end user apply.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and the Apple Standard EULA. This license is for your personal or internal business use only.

2. Restrictions

You may not copy, modify, reverse engineer, decompile, disassemble, sublicense, rent, lease, or distribute the App, except to the extent such restrictions are prohibited by applicable law. You may not use the App for any unlawful purpose.

3. Subscriptions and Auto-Renewal

The App offers auto-renewing subscriptions under a single subscription group, “Booth Membership”:

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. Any unused portion of a free trial is forfeited when you purchase a subscription. There are no lifetime purchases and no consumable products.

4. Managing and Cancelling Your Subscription

You can manage your subscription and turn off auto-renewal at any time through your Apple ID settings: open the Settings app on your device, tap your name, then tap Subscriptions. You may also visit apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period. Subscriptions are handled by Apple; refund requests are governed by Apple's policies.

5. AI-Edited Images and Disclosure Responsibility

Booth can replace image backgrounds using on-device AI and embeds transparency metadata in such exports. You are solely responsible for disclosing AI-edited or AI-generated imagery as required by the platforms where you publish (for example, Etsy, Shopify, Instagram, or Pinterest) and by applicable law, including the EU AI Act (Article 50) and California AB 942. You agree not to remove or alter the disclosure metadata in a way that violates these obligations.

6. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that results, including edited images, will meet your requirements.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the App. Our total aggregate liability for any claim relating to the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

8. Third-Party Terms

Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you. Use of the App may also be subject to Apple's terms, including for the App Store and, where applicable, iCloud.

9. Termination

This Agreement is effective until terminated. Your rights under it terminate automatically if you fail to comply with its terms. Upon termination, you must stop using and delete the App.

10. Governing Law and Changes

This Agreement is governed by applicable law without regard to conflict-of-law principles, and subject to any mandatory consumer-protection rights in your jurisdiction. We may update this Agreement from time to time; the “Last updated” date above reflects the current version.
