Phase

Terms of Use · EULA

The rules of the road.

By installing or using Phase, you agree to these terms. They are written to be read, not skipped.

Acknowledgement

Phase is an information and tracking tool for adults experiencing perimenopause or menopause. It is not a medical device, not a diagnostic tool, and not a substitute for advice from a licensed healthcare provider.

1. Who can use Phase

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or use the in-app community ("The Room"). Phase is intended for adults experiencing perimenopause or menopause and the people who care for them.

2. Your subscription

3. Acceptable use

When using Phase — and especially The Room — you agree not to:

We may suspend access to The Room if you breach these rules. See Community Guidelines for details.

4. Your content in The Room

You retain ownership of the messages you write. You grant Phase a non-exclusive license to display them to other members of the same cohort and to store them in encrypted form on your device. Because we cannot read your messages, we cannot moderate them at the content level — we rely on your reports and on-device blocking. See Community Guidelines for what happens after you report a message.

5. Health information disclaimer

The information surfaced by Phase — including symptom averages, "What's high" lists, and correlation insights in the Pattern Report — is generated algorithmically from the data you log. It is provided for informational purposes only. It is not a diagnosis. It is not a treatment plan. It is not a substitute for evaluation by a qualified healthcare professional.

If you think you are having a medical emergency, call your local emergency number immediately. Do not rely on Phase to deliver urgent care.

6. Intellectual property

The Phase name, logo, app, and all related materials are owned by us. You receive a personal, non-transferable, revocable license to use the app on iPhones and Apple Watches you control, in accordance with the Apple Media Services Terms.

7. Apple-specific terms (EULA)

The standard Apple App Store EULA (the "Licensed Application End User License Agreement") applies to your use of Phase, except where superseded by the additional terms above. The standard EULA is available at apple.com/legal/internet-services/itunes/dev/stdeula/.

You acknowledge that the agreement is between you and us, not between you and Apple. Apple is not responsible for the app or its contents and has no obligation to provide maintenance or support.

8. Disclaimer of warranties

Phase is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Phase will be uninterrupted, error-free, or accurate at any moment.

9. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of Phase. Our total liability for any claim relating to Phase will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US$50.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your breach of these terms, your content in The Room, or your violation of applicable law.

11. Changes

We may update these terms. Material changes will be announced in-app on next launch. Your continued use after the change constitutes acceptance.

12. Governing law & disputes

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. You and we agree to resolve disputes in the state or federal courts located in San Francisco County, California, except where prohibited by law.
